Terms and Conditions These Terms and Conditions ("Terms") govern your use of the services provided by Invested Youth, LLC ("Invested Youth," "we," "us," or "our"), including access to our video courses and day camps. By accessing or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.
1. Agreement to Terms By accessing or using our website, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our services.
2. Disclaimer The content provided in our courses is for educational purposes only and does not constitute legal advice, financial advice, or business advice. Invested Youth is not responsible for any losses or damages that may result from your use of the content. Businesses and investments involve significant risks, and you should consult with a licensed professional before making any decisions.
3. Content and User Conduct We are not liable for any content, including comments, images, or other materials, that users or their children may be exposed to while using our services. While we strive to maintain a safe and appropriate environment, parents and guardians are responsible for monitoring their children’s activity on our platform. Appropriate Conduct: All users, including parents and guardians, agree to keep comments, images, and any other content appropriate for children. We reserve the right to remove any content that we determine, in our sole discretion, to be inappropriate or harmful.
4. User-Generated Content (UGC) Policy Monitoring and Moderation: We reserve the right to monitor, moderate, and remove user-generated content that violates these Terms or is deemed inappropriate. License to Use UGC: By posting content on our platform, you grant us a non-exclusive, royalty-free, perpetual, and worldwide license to use, display, and modify such content as part of our services.
5. Prohibited Activities List of Prohibited Activities: You agree not to engage in any prohibited activities on our platform, including but not limited to hacking, spamming, distributing malware, harassment, or impersonation.
6. Third-Party Links and Services Disclaimer of Responsibility: Our website or services may contain links to third-party websites or services. We are not responsible for the content, accuracy, or practices of any third-party sites. Your use of third-party sites is at your own risk.
7. Parental Consent for Minors Parental Responsibility: By allowing their children to use our services, parents or guardians consent to these Terms on behalf of their children and are responsible for their children's activity on the platform.
8. Updates and Maintenance Service Interruptions: We may need to perform updates or maintenance that could result in temporary interruptions to our services. We are not liable for any loss or inconvenience caused by such interruptions.
9. Feedback and Suggestions No Obligation to Implement: Any feedback or suggestions you provide are voluntary, and we have no obligation to implement or compensate you for such ideas.
10. Waiver of Rights No Waiver: Any failure by us to enforce any provision of these Terms does not constitute a waiver of our right to enforce that or any other provision in the future.
11. Class Action Waiver Individual Claims Only: Any disputes must be resolved on an individual basis. You agree to waive any right to participate in class action lawsuits or class-wide arbitration against us.
12. Refund Policy We strive to provide excellent service to all our customers. Our refund policy is as follows:
Traditional Payments: For purchases made directly through our website with traditional payment methods (Credit card, debit card, cash, check, etc), we offer a 14-day refund policy from the date of payment. Refunds requested within this period will be processed promptly.
Scholarship and Education Program Payments: Many scholarship programs and education funding sources do not allow for refunds. To align our return policy with these guidelines, we generally do not offer refunds for payments made using scholarship funds, ESAs, or other education programs. However, if your specific scholarship or funding program permits refunds, we will honor them according to their requirements, up to a maximum of 14 days or the minimum refund period required by the program, whichever is shorter.
Refund Discretion: All refunds are at our sole discretion, and we reserve the right to deny any refund requests that do not meet our policy criteria.
13. Use of Services Our services, including video courses and day camps, are intended for educational purposes. By using our services, you agree to: Use the services only for lawful purposes and in compliance with these Terms. Respect the intellectual property rights of Invested Youth and other users. Provide accurate and truthful information when registering for our services.
14. Intellectual Property All content provided through our services, including but not limited to videos, course materials, and website content, are the intellectual property of Invested Youth or its licensors. You may not reproduce, distribute, modify, or create derivative works based on our content without prior written consent.
15. Limitation of Liability To the fullest extent permitted by law, Invested Youth shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with your use of our services, whether based on warranty, contract, tort (including negligence), or any other legal theory. We are not responsible for any content posted by users or the exposure of children to inappropriate content.
16. Indemnification You agree to indemnify and hold harmless Invested Youth, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your use of our services or violation of these Terms.
17. Payment Policy Payment Options: Full Payment: You can pay the full amount upfront for access to the entire school year course (August to May). Monthly Payment Plan: Alternatively, you can choose a monthly payment plan, which spreads the cost over 12 months. This plan will automatically renew for the next school year unless canceled in writing at least 30 days before the end of the current payment cycle. Late Payments: If a monthly payment is missed, access to the course may be temporarily suspended until the account is brought current. Continued failure to make payments may result in permanent loss of access. Our Right to Cancel: We reserve the right to cancel any account for any reason at any time. In the event of cancellation by us, refunds will be issued at our sole discretion. Chargebacks: Any chargebacks initiated by the customer will result in a $75 administrative fee, in addition to the original payment amount owed. This fee covers the costs associated with processing the chargeback. Collections and Legal Action: If payment is not received and the account remains delinquent, we reserve the right to send the account to collections. The customer will be responsible for any and all collection fees, attorney's fees, court fees, administrative fees, and any other costs incurred in the process of collecting payment.
18. Disclaimer of Warranties As-Is Basis: Our services are provided on an "as-is" and "as-available" basis. We make no warranties, express or implied, regarding the quality, accuracy, reliability, or availability of our services, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Your use of our services is at your own risk.
19. Copyright and Intellectual Property Rights All content provided through our services, including but not limited to text, graphics, images, videos, course materials, and other multimedia content (collectively, "Content"), is the exclusive property of Invested Youth, LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. Copyright Notice: The Content is copyrighted and owned by Invested Youth, LLC. Any unauthorized use, reproduction, distribution, modification, or creation of derivative works based on the Content, in whole or in part, is strictly prohibited without the express written consent of Invested Youth, LLC. Enforcement of Rights: We vigorously enforce our intellectual property rights to the fullest extent of the law. Any unauthorized use or exploitation of our Content may result in civil and criminal liability. Invested Youth, LLC reserves the right to pursue all legal remedies, including seeking compensation for damages, attorney’s fees, and costs incurred due to unauthorized use of our Content. Reporting Infringements: If you believe that any Content on our website infringes upon your intellectual property rights, please notify us immediately so that we can investigate and address the issue accordingly. Permission for Use: Any use of our Content that is not expressly permitted by these Terms requires prior written authorization from Invested Youth, LLC. Unauthorized use of our Content will be subject to legal action and financial claims for damages.
20. Severability Clause Enforceability: If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.
21. Force Majeure Unforeseen Events: Invested Youth shall not be liable for any delay or failure to perform its obligations under these Terms if such delay or failure is caused by circumstances beyond our reasonable control, including but not limited to natural disasters, acts of God, war, terrorism, labor disputes, cyber-attacks, or governmental actions.
22. Limitation on Claims Timeframe for Claims: Any claim or cause of action arising out of or related to your use of our services or these Terms must be filed within one (1) year after such claim or cause of action arose, or it will be forever barred.
23. Electronic Communications Consent to Electronic Notices: By using our services, you consent to receive communications from us electronically. We will communicate with you by email or by posting notices on our website. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
24. Dispute Resolution and Jurisdiction Arbitration: Any dispute arising out of or relating to these Terms or the use of our services shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. The arbitration shall take place in Utah, unless otherwise agreed by all parties. Governing Law and Jurisdiction: These Terms and any dispute arising out of or in connection with them shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law principles. The exclusive jurisdiction and venue for any legal action arising under these Terms shall be the state and federal courts located in Utah. By using our services, you agree to waive any right to a jury trial and to participate in arbitration and jurisdiction proceedings as outlined above.
25. Modifications to Terms We reserve the right to modify these Terms at any time. Any changes to these Terms will be effective immediately upon posting on our website. Your continued use of our services after the posting of any revised Terms constitutes your acceptance of the changes.
